    It is not clear what your question is. On the assumption that you are asking whether the child can be removed - this is a question of fact. The law provides that certain specified civil servants can, if they are satisfied on reasonable grounds that a child or young person is in need of care or protection, remove the child or young person and commit the child or young person to a place of temporary care and protection.
