  • Even if parties are staying in the same house but living in different rooms, this may be considered for legal purposes "to be living separately". More importantly, as long as parties are no longer living as a married couple would do (i.e. eating together, washing laundry together, engaging in sexual intimacy etc.), then it may be considered that parties are "living separately". If parties both consent that they have "lived separately", then they may proceed with divorce on an uncontested basis. DCHAN 17/10/2016
