Can you claim non-pecuniary losses (loss of amenity) and pecuniary loss (diminution of value) at the same time?

There is nothing specifically prohibiting a claim for both non-pecuniary and pecuniary losses at the same time. It boils down to a question of double recovery: where, for example, the loss of amenity causes a diminution in value of a property, the court would not award both as this would be allowing the plaintiff to recover twice for the same loss.
