    It is a liquidated damage. The clause that stipulates that you are required to pay 9K is enforceable only if the amount is the actual amount of loss or reasonable estimation. If the 9K of "staff costs and training fees" are far below actual loss or loss that is reasonably estimated, the clause is considered penalty clause, and thus unenforceable.
