    If the filming is carried out in a personal or domestic capacity, there is no obligation to obtain consent. If the filming is carried out in the capacity of an employee who was acting in the course of his employment with an organisation, there is no obligation to obtain consent, but the person filmed may sue the employer should he/she have incurred any losses or damages directly arising from the filming. Additionally, there may be criminal liability under the Protection from Harassment Act, if the person filming had intended to cause harassment, alarm or distress, and the filming is threatening, abusive or insulting behaviour, unless the person filming can show that he/she had acted reasonably.
